Terms and Conditions
1. Parties
These Terms and Conditions apply to the agreement between Launceston City Mission (LCM) ABN 77 205 956 084, herein referred to as “City Mission”, and the Client identified in the Services Onboarding Agreement.
2. Service Overview
City Mission will provide the Client with:
Use of branded 240L bins designated for eligible recyclable containers;
If specified, pickup and replacement of filled bins from a defined pickup location as per agreed schedule or on request;
Processing of collected containers through the City Mission Automated Depot(s);
Refunds based on eligible container volumes as per the arrangements in the Engagement Form.
3. Customer Responsibilities
The Client agrees to:
Only place eligible containers in the bins (as defined by the Tasmanian Container Refund Scheme legislation);
Keep bins secure and in a reasonably clean condition;
Make bins accessible on the scheduled pickup day or as arranged;
Notify City Mission if bins are lost, damaged, or contaminated.
4. Ownership and Use of Bins
All bins remain the property of City Mission.
Misuse, damage, or theft of bins may result in replacement charges.
City Mission may inspect bins or request corrective actions if contamination is found.
City Mission reserves the right to charge a $100 ex. GST replacement fee for bins that are lost, stolen or damaged.
5. Refund and Donation Arrangements
The handling of the 10-cent refund per eligible container is based on the selection made in the Engagement Form:
Bin Supply and Collection Services: 100% of the refund is donated to City Mission (a tax-deductible receipt will be issued);
Bin Supply: A split (e.g., 70/30 or 50/50) between the Client and City Mission;
6. Service Fees
City Mission does not charge rental or pickup fees where containers are donated in full.
For shared or full refund models, a collection service fee may be deducted from the refund, or charged separately as agreed.
7. Monthly Reporting and Tax Receipts
City Mission will provide the following to the Client within 30 days of the end of each calendar month:
A summary of the total number of eligible containers collected and processed;
A breakdown of the refund value associated with those containers;
A tax-deductible receipt for any portion of refunds donated to City Mission.
8. Service Access and Safety
The Client is responsible for ensuring safe and legal access to the bin pickup location, including clear paths and safe parking.
Bins should not be placed on public roads or footpaths without permission.
9. Termination and Suspension
Either party may terminate the agreement with 14 days’ written notice.
City Mission may suspend services immediately in case of repeated contamination, safety concerns, or misuse.
10. Liability and Indemnity
City Mission will take all reasonable care during collection and bin handling but will not be liable for any damage caused by access issues or obstructions.
The Client indemnifies City Mission against any claims arising from non-compliance with these Terms.
11. Privacy and Communications
City Mission will only collect and use Client information for the purpose of delivering the service and issuing tax receipts where applicable.
Clients agree to receive occasional communications about program updates unless opted out.
12. Marketing and Publicity
The Client grants City Mission permission to use their business name, logo, and general information about the services provided (such as participation in the Recycle Rewards program, container volumes collected, and donation impact) for marketing and promotional purposes. This may include use in social media, website content, printed materials, and reports. City Mission agrees to represent the Client positively and respectfully. If the Client prefers to opt out of promotional use, they may do so at any time by notifying City Mission in writing.
